In tractor trailer truck accidents, the driver is always the focal point of the case. The question is has the driver been disqualified as a truck driver. Recently, we had a case where the driver’s driving license was revoked and he was driving a dump truck when he crashed into our client. The truck driver can be disqualified if he or she has been convicted of certain criminal charges. There are several offenses which would bar a truck river from operating a big rig. The main reason is a conviction of a DUI or DWI charge. The Federal Motor Carrier Safety Act spells this out in section 391.15 of the act.
