The Tenneessee Titans have filed a motion to dismiss a lawsuit involving Adam “Pac Man” Jones in Las Vegas, Nevada. The victims of the shooting have alleged that the Titans are somehow responsible for the injuries sustained as a result of the shooting. I have not read the motion, however, I presume counsel for the Titans are alleging the Titans could not have foreseen the criminal acts that lead to the shooting. Under Tennessee law, the critical issue is whether or not the criminal act was foreseeable to the Titans or whether or not the TItans knew Adam “Pac Man” Jones might act in this way. Any business owner, which would include the Titans, has no duty to the public to prevent a criminal act absent some notice that an employee might cause harm to another. An example of potential liability on the part of an employer is if the employer ran a criminal background check that revealed assault charges and they hired the employee anyway. A tragedy occured ,but it appears the Titans are no responsible .
